Malaysian Personal Data Protection Commission consults on proposed amendments to Personal Data Protection Act 2010

On 12 February 2020, the Personal Data Protection Commission (“PDPC”) issued Public Consultation Paper No. 01/2020 (“Public Consultation Paper”) on the review and proposed amendment of the Personal Data Protection Act 2010 (“PDPA”). This was followed by a series of face-to-face public consultations which were held from 14 February 2020 to 28 February 2020.
Gobind Singh Deo, the Minister of Communications and Multimedia at that time, stated that the proposed amendments to the PDPA were important to strengthen the protection of personal data in Malaysia, in particular, taking into consideration the emerging issues on personal data protection impacting both data users and data subjects from economic, social and technology aspects. The review of the PDPA is being conducted with the aim of focusing on the effective implementation of the PDPA in comparison with the implementation of data protection laws in foreign jurisdictions, including the European Union’s General Data Protection Regulation.
