The Court of Appeal in Chrishanthini Angela Regina Sebastiampillai v View Esteem Sdn Bhd [2022] 1 LNS 2212 reaffirmed the position that home buyers can seek to recover costs of rectification works incurred and compensation for defects under common law notwithstanding the co-existence of a prescribed contractual remedy.
